Agreement to Terms

Welcome to Echo Files. These Terms of Service ("Terms") govern your access to and use of our file storage and management platform. By creating an account or using our service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our service. We reserve the right to modify these Terms at any time, and we will notify you of significant changes.

Account Registration

Eligibility

To use Echo Files, you must:

• Be at least 13 years of age (or the age of majority in your jurisdiction)
• Provide accurate, complete, and current registration information
• Maintain the security of your account credentials
• Not have been previously banned or suspended from our service

Account Responsibility

You are responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your password
• Notifying us immediately of any unauthorized access
• Ensuring your email address is valid and accessible

Account Types

We offer different account types with varying features:

• Free Accounts: 10GB storage with standard features
• Admin Accounts: Enhanced permissions for system management (by invitation only)

Acceptable Use

Permitted Uses

You may use Echo Files to:

• Store, organize, and manage your personal or business files
• Share files with others through secure share links
• Access your files via web interface, FTP, SFTP, or API
• Collaborate with team members on shared files and folders
• Create backups of your important data

Prohibited Uses

You agree NOT to use Echo Files to:

• Illegal Content: Store, share, or distribute illegal materials, including pirated content
• Malware: Upload or distribute viruses, malware, or other harmful code
• Copyright Infringement: Store or share content that violates copyright, trademark, or intellectual property rights
• Harassment: Harass, threaten, or harm others
• Spam: Send unsolicited messages or use our service for mass distribution
• Phishing: Engage in phishing, fraud, or identity theft
• Adult Content: Store or share explicit adult content (pornography, obscene materials)
• System Abuse: Attempt to breach security, overwhelm servers, or disrupt service
• Scraping: Use automated tools to scrape or harvest data without permission
• Reselling: Resell or redistribute our service without authorization

Content Ownership and Rights

Your Content

You retain all ownership rights to the files and content you upload to Echo Files. We do not claim ownership of your files.

License to Operate

By uploading content, you grant us a limited license to:

• Store, process, and transmit your files to provide our service
• Display your shared content to users you authorize
• Generate thumbnails and previews of your files
• Perform virus scanning and security checks (if enabled)
• Create backups for service reliability

This license exists solely to operate our service and ends when you delete your content or account.

Content Responsibility

You are solely responsible for:

• The legality, reliability, and appropriateness of your content
• Ensuring you have the right to upload and share your files
• Any consequences of uploading or sharing prohibited content
• Maintaining backups of critical data

Storage and File Limits

Storage Quotas

• Default Storage: 10GB per free account
• File Size Limits: Determined by administrator settings (typically 100MB-5GB per file)
• File Types: Most file types allowed; some may be restricted for security

Storage Management

If you exceed your storage quota:

• You will be unable to upload new files until space is freed
• Existing files will remain accessible
• You can delete files or upgrade your account (if available)

File Retention

• Active Files: Stored indefinitely while your account is active
• Trash: Deleted files retained for 30 days before permanent deletion
• Inactive Accounts: Accounts inactive for 12+ months may be archived or deleted
• File Versions: Previous versions retained based on administrator settings

File Sharing

Share Permissions

When sharing files, you can set:

• Access Levels: View-only, download, or full edit permissions
• Password Protection: Require a password to access shared content
• Expiration Dates: Automatically expire share links after a specified time
• Public vs. Private: Share with specific users or create public links

Sharing Responsibility

You are responsible for:

• Ensuring you have the right to share the content
• Managing and revoking share permissions appropriately
• Not sharing inappropriate or illegal content
• Understanding that shared content may be downloaded by recipients

API and FTP Access

API Usage

If you use our REST API:

• Comply with rate limits (typically 60 requests/minute per user)
• Use API tokens securely and do not share them publicly
• Follow API documentation and best practices
• Report security vulnerabilities responsibly

FTP/SFTP Access

If you enable FTP or SFTP:

• Keep your FTP credentials secure
• Use SFTP (port 22) for encrypted connections when possible
• Be aware that FTP connections are logged for security
• Disable FTP access if not actively used

Security and Data Protection

Our Security Measures

We implement:

• 256-bit SSL/TLS encryption for all data transmission
• Bcrypt password hashing with salt
• SHA-256 file integrity verification
• Two-factor authentication support
• Activity logging and monitoring
• Regular security audits

Your Security Responsibilities

You must:

• Use a strong, unique password
• Enable two-factor authentication when possible
• Keep your devices and software updated
• Not share your account credentials

Data Breaches

In the unlikely event of a data breach affecting your account, we will notify you via email within 72 hours of discovering the breach and provide guidance on protective actions.

Service Availability and Modifications

Service Uptime

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted access. Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice)
• Emergency security patches
• Technical issues beyond our control
• Force majeure events

Service Changes

We reserve the right to:

• Modify features, functionality, or user interface
• Update storage limits or file size restrictions
• Add or remove file type support
• Change API endpoints or rate limits (with notice)
• Discontinue the service with 30 days' notice

Account Suspension and Termination

We May Suspend or Terminate

We may suspend or terminate your account if:

• You violate these Terms of Service
• Your account is used for illegal activities
• You engage in abusive behavior toward users or staff
• Payment issues arise (if applicable)
• Your account is inactive for an extended period
• Required by law or legal process

You May Terminate

You may terminate your account at any time by:

• Using the "Delete Account" option in Settings

Effect of Termination

Upon account termination:

• All files will be permanently deleted within 30 days
• Shared links will no longer function
• API tokens will be revoked immediately
• FTP/SFTP access will be disabled
• You may request a data export before deletion (within 7 days)

Disclaimers and Limitations

Service "As Is"

Echo Files is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Complete security or data integrity
• Accuracy or reliability of content

Limitation of Liability

To the maximum extent permitted by law, Echo Files and its operators shall not be liable for:

• Loss of data, files, or content
• Business interruption or loss of profits
• Indirect, incidental, or consequential damages
• Unauthorized access to your account
• Content uploaded by other users

Backup Responsibility

While we perform regular backups, you are responsible for maintaining your own backups of critical data. We are not liable for data loss under any circumstances.

Indemnification

You agree to indemnify and hold harmless Echo Files, its operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or share
• Unauthorized access resulting from your negligence

Dispute Resolution

Informal Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Echo Files operates, without regard to conflict of law principles.

Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with applicable arbitration rules.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an email notification for significant changes
• Displaying an in-app notification upon your next login

Your continued use of Echo Files after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the service and delete your account.

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Echo Files regarding the use of our service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.
